Malaysia Vaping Laws

The Control of Smoking Products for Public Health Act 2024 (Act 852) has been in force since 1 October 2024. It defines smoking to include vapour, bans the sale of vapes to anyone under 18, and makes it an offence for under-18s to buy them, with a fine of up to RM500 or community service. Smoking or vaping in a gazetted non-smoking area carries a fine of up to RM5,000, and the owner or occupier must take all reasonable measures to stop people smoking there (Act 852, sections 2, 13, 16 and 18).

The rules are still moving. Perak has stopped licensing vape shops, and the legal status of nicotine liquid has been in question since a 2026 High Court ruling (Malay Mail; CodeBlue, 2026). Sensors help principals and building managers show they are taking reasonable steps, whatever changes next.
